Nine months after the gangrape and brutal murder of 23 year old Nirbhaya,a Special Court sentenced capital punishment to the four convicts.Additional Sessions Judge Yogesh Khanna announced the punishment at around 2.30 pm.Yogesh Khanna  said it is the "rarest of the rare case" and has "shocked the collective conscience of the nation".


Nirbhaya's mother expressed satisfaction over the verdict.


"'Halak mein saans atki thi, jo ab bahar nikli hai. Mein dhanywaad karti hu desh ke logon ka aur media ka' (We were waiting with bated breath, now we are relieved. I thank the people of my country and the media)"


Delhi gangrape: All four accused sentenced to death


Four convicts in the December 16 gangrape-cum-murder case were on Friday awarded death penalty by a Delhi court which said the gravity of the offence cannot be tolerated.

"Death to all," Additional Sessions Judge Yogesh Khanna said while delivering the verdict in the case that had evoked nationwide outrage and led the government to bring in a stringent anti-rape law.

"Besides discussing others offences, I straightaway come to section 302 (murder) of IPC. This falls under inhuman nature of the convicts and the gravity of offence they committed cannot be tolerated. Death sentence is given to all the four convicts," he said.

The offence committed by Mukesh (26), Akshay Thakur (28), Pawan Gupta (19) and Vinay Sharma (20) falls under the rarest of rare category warranting capital punishment, the judge said.

The four were convicted by the court on September 10 for the gangrape and murder of a 23-year-old paramedic student.

"Court cannot turn a blind eye to such a gruesome act," the judge said, while handing down the maximum punishment.

He said, "When crime against women is rising on day-to-day basis, so, at this point in time court cannot keep its eye shut."

"There should be exemplary punishment in view of the unparallelled brutality with which the victim was gangraped and murdered, as the case falls under the rarest of rare category. All be given death," the court said while reading out a portion of the order.

"This is a time when serious crime against a woman has come to the fore and now its judiciary's responsibility to instill confidence among the women," it said.

Besides murder, the four have been also convicted for offences including gangrape, unnatural offences, attempt to murder, dacoity, destruction of evidence, conspiracy, kidnapping or abducting in order to murder, while acquitting them of the charge of murder in dacoity.

Immediately after pronouncement of sentence, the victim's mother expressed satisfaction over the verdict.

Besides her, the victim's father and two brothers were also present in the jam-packed court room when the sentence was pronounced.

Hearing that he will face the gallows, Vinay started crying in court while the other three convicts -- Mukesh, Pawan, Akshay -- started shouting for pardon, with one of the defence lawyers A.P. Singh also joining them in seeking mercy.

Advocate V K Anand, who appeared for Mukesh, said he has regard for the verdict and he will file an appeal in the Delhi High Court.

Special public prosecutor Dayan Krishnan said, "I have done my job and we (prosecution) are happy with the verdict."

Soon after the verdict was delivered, people waiting outside the courtroom started clapping.

Delhi gang-rape: 4 convicts get death; we are happy, says girl's father


New DelhiMoments after four men found guilty of the gang-rape and murder of a 23-year-old student were sentenced to death, her parents said they were relieved and happy.

"I can finally breathe, I am relieved" said the girl's mother, her husband and two sons by her side. "No victim should remain silent. They must come forward and report the crime."

"We are happy. Justice has been delivered," added her father.

Akshay Thakur, Pawan Gupta, Vinay Sharma and Mukesh Singh were sentenced to death by hanging at a fast-track court in Delhi today. They were found guilty of "cold-blooded murder" on Wednesday.  

The girl's family sat in the packed courtroom, not far from the convicts, as the judge announced, "death to all", classifying the crime as the rarest of rare, which justified capital punishment.

Before the hearing, the mother broke down while talking to reporters. "Today I keep remembering her life, the pain she suffered." She was with her daughter when she died in Singapore, 13 days after the savage assault.

The family had sold their land and invested their heart and soul in their daughter's dreams, financing her physiotherapy education despite their modest income.

This was a day they had anticipated for nine months, ever since their daughter died of the horrific injuries inflicted by the men who violated her so brutally with an iron rod that her internal organs were irreparably damaged.

"They have shown no remorse. She wanted them to be set on fire," the mother had said earlier.
 
The parents have repeatedly demanded the death sentence for their daughter's killers. "They did not spare her," her father said after the men were convicted, "why should they be shown any mercy?"

Delhi gang-rape case: All four convicts awarded death sentence
NEW DELHI: After a nine-month-long trial, fast track court on Friday handed down death penalty to all the four convicts in the Nirbhaya gang rape and murder case. The court while pronouncing the judgment said that "it cannot turn a blind eye on the rising cases of sexual assualt against women" and that the incident shook the "collective conscience of the society". The court said the case falls under rarest of rare category. 

"In these times when crime against women are on rise, we cannot turn a blind eye towards such gruesome crime,we need to send a message that it will not be tolerated," the judge said. 

Gym instructor Vinay Sharma, bus cleaner Akshay Thakur, fruit-seller Pawan Gupta and Mukesh Singh, who were found guilty in all 13 charges, including murder and rape, were given death sentence by judge Yogesh Khanna today. Out of the six men arrested in the case, Ram Singh committed suicide inside Tihar Jail. Another accused, who was 17 at the time of the crime, was sent to reform home for three years by a juvenile court.

The shocking rape-murder case had triggered nationwide protests and debate over women safety in the country and eventually saw the Parliament passing a stringent change in rape laws.

The Indian Penal Code (IPC) was amended to provide death penalty in rape cases that cause death of the victim or leave her in a vegetative state. The Act also introduced several other new offences such as causing grievous injury through acid attacks, sexual harassment, use of criminal force on a woman with intent to disrobe, voyeurism and stalking.

Besides gang rape and murder, the court had held Mukesh (26), Vinay Sharma (20), Pawan Gupta (19) and Akshay Singh Thakur (28) guilty of attempt to murder, unnatural offences, dacoity, destruction of evidence, conspiracy, kidnapping or abducting in order to murder, while acquitting them of the charge of murder in dacoity.

Additional sessions judge Yogesh Khanna, presiding the special fast track court, also convicted them for kidnapping or abducting with intent to secretly and wrongfully confining a person, abducting to subject a person to grievous hurt and slavery, abducting woman to cause her defilement, voluntarily causing hurt in committing robbery and dishonestly receiving property stolen in the commission of a dacoity of the IPC.

"The accused have also tried to destroy the evidence after the incident, so they are convicted under section 201 of the IPC. They had abducted the victim to have illicit intercourse with her, so they are convicted under section 366 of the IPC," the judge had said while pronouncing the judgement on Tuesday.

While pronouncing the verdict, the judge said, even though the proceedings against accused Ram Singh (34), who was found dead in his prison cell after he committed suicide on March 11, were abated, "he is also convicted under same sections (gang rape, murder and other offences)".

On the night of December 16, last year, Ram Singh, Vinay, Akshay, Pawan, Mukesh and the juvenile had gang-raped the girl in a bus after luring her and her 28-year-old male friend, who was also assaulted, on board the vehicle, which was later found to be plying illegally on Delhi roads.

The victim's friend, a software engineer, had fractured his limbs in the incident. The girl succumbed to her injuries on December 29, 2012 at a Singapore hospital.

Nirbhaya may rest in peace; Death sentence for all 4


New Delhi, Sept 13: The nation's wait for justice has finally come to an end. And with that, there comes a hope for change in the jurisdiction, a society and the mentality of its people. Nirbhaya may finally rest in peace! In a crisp 5 minutes sentencing, the Delhi court has ordered death sentence to all the four convicts. 

2:32 pm: Accusing of political conspiracy, the defence counsel says that he would move the case to High Court. In a rather irresponsible statement, the defence counsel, further says that he would not move the HC if there are no rape cases in the next 2-3 months time.

 2:30 pm: The Delhi court has given death sentence to all the 4 convicts.

 1:25 am: Nirbhaya's parents are positive about the court's judgement and believe that the judiciary would stand by them like the people and the government. However, her father says that if the court fails to give justice to their daughter, they would move the High Court.

 1:30 pm: The four convicts have been brought to court for the sentencing.

 12:51 pm: As time approaches, media and public gather around the court, awaiting for the verdict. 

11:32 am: Convict Vinay Sharma's mother pleaded mercy for her son, saying that he was just 19 at the time of crime. 'Even God gives one a second chance. The judge should give them a second chance to reform themselves.', she said. The lawyer of Vinay Sharma also banked on the same point, while arguing his case.

 11:30am: The rape was brutal and one of the rarest of rare cases in the Indian judiciary. It could also be considered unnatural as the act of raping Nirbhaya and meting internal injuries to her were pre-planned. Nirbhaya and the male friend, accompanying her, were thrown out of the running bus and attempts were made to run it over them. Nirbhaya's clothes were torn apart and used for wiping the blood and the organs off the floor. 

11:24 am: The Saket Court  found the four convicts guilty on all 13 criminal counts earlier on Wednesday. The court based its judgement on the forensic and the circumstantial reports. The forensic reports included investigation of the blood sample, the semen sample and the dental structure of the convicts. The prosecution has demanded capital punishment for the convicts, while the defence depends heavily on the mercy of the judge. Recalling the last few days of Nirbhaya, her mother says that she wanted these men to be burnt alive. Public on the other hand wants the judiciary to hand these men to them for the punishment

The decision was taken in Saket court in Delhi...As soon as news came of capital punishment,people bursted crackers outside...
May Nirbhaya's soul rest in peace and I soon get the news of those beasts's death.

While I am happy that these 4 are sentenced to death [though I'd have preferred punishments like castrations/flogging etc], what aggravates and affronts me is the fact that the juvenile, the one who caused Nirbhaya the MOST harm is the one sentenced to 3 years in remand. Beyond ridiculous. 

If the guy had the mindset to be able to rape and abuse a person to such an extent, he is most certainly NOT a juvenile. The govt needs to develop a mindset to sentence people based on their crimes, not on their age.
